What Is an NFA Gun Trust?

An NFA gun trust — also called a gun trust, firearms trust, or suppressor trust — is a legal entity specifically designed to hold Title II firearms regulated under the National Firearms Act.

What it holds

Suppressors (silencers), short-barreled rifles (SBRs), short-barreled shotguns (SBSs), machine guns (pre-1986), destructive devices, and any other weapons (AOWs).

Why a trust — not individual ownership

A trust allows multiple co-trustees to possess and use NFA items legally without the registered owner being present. It also simplifies inheritance and avoids probate complications.

The ATF Form 4 (transfer) process

When you purchase an NFA item from a dealer, your trust submits an ATF Form 4 with a $200 tax stamp. The ATF approves the transfer — currently taking several months — before you take possession.

The ATF Form 1 (make) process

If you are building or converting a firearm into an NFA item (such as an SBR), you submit Form 1 before making any modifications. Your trust can own and Form-1 items just as it can Form-4 items.

No — but you should have one. How long does the process take?
