Why State Law Matters for NFA Trusts
NFA trusts must comply with two layers of law: federal ATF requirements and your state's trust statutes. A trust valid in one state may not be valid in another. Generic online templates rarely account for these differences.
State Trust Law
Each state has its own statutes governing trust formation, trustee duties, and amendment procedures. Your trust must comply with the law of the state where it is established.
State Firearms Law
Some states prohibit certain NFA items entirely — regardless of federal approval. Others have additional registration or licensing requirements beyond ATF compliance.

Florida
Florida is an NFA-friendly state with no additional state-level requirements beyond federal ATF compliance. Suppressors, SBRs, and SBSs are all legal for civilian ownership with proper ATF approval. Florida trust law is well-developed and I tailor each trust document to Florida statutory requirements.

Texas
Texas is one of the most NFA-friendly states in the country. All NFA items legal under federal law are legal in Texas. Texas also has the Texas Firearms Freedom Act and additional protections for in-state firearm manufacture. Trusts for Texas clients are drafted to comply with the Texas Trust Code.

Virginia
Virginia permits civilian ownership of all federally legal NFA items. As a Maryland attorney, I note that Virginia clients requiring legal representation are referred to licensed Virginia counsel — but I can provide NFA trust documents to Virginia clients consistent with bar admission rules.

Pennsylvania
Pennsylvania permits ownership of suppressors, SBRs, SBSs, and other NFA items with proper ATF approval. Pennsylvania has no additional state-level registration requirements. Trust documents are drafted to comply with the Pennsylvania Uniform Trust Act.

Georgia
Georgia is NFA-friendly and permits all federally legal NFA items. Georgia has a strong shooting culture and high demand for suppressor trusts in particular. Trust documents are drafted to comply with Georgia's trust statutes.

Maryland

North Carolina
North Carolina permits civilian ownership of all federally legal NFA items. NC has no additional state registration requirements. Trust documents are drafted to comply with North Carolina's Uniform Trust Code.

Tennessee
